Terms and Conditions
TERMS:
- Real Estate
- $5,000 down the day of Auction, balance due in full upon delivery of the merchantable title and deed free and clear of all liens and encumbrances except as stated herein and subject to easements or restrictions of record.
- A 5% Buyer's Premium will be added to the final bid and included in the total contract price.
- The seller will provide the buyer with a commitment of title insurance in the amount of the purchase price insuring the transfer and marketability of title.
- Business Equipment
- 10% Buyer's Premium will be charged on everything except the real estate.
- Cash or good check will be accepted as payment.
- All equipment must be removed from the property by 5:00 p.m. on 6/30/08.
Offers will be considered and property may be sold prior to auction.
CONDITIONS: Bidding is not conditional upon financing. If financing is necessary it should be arranged prior to the auction. Buyer's obligation to purchase is not subject to financing or any other contingency.
TAXES: Buyer shall assume and pay real estate taxes due and payable in November, 2008
POSSESSION: Day of closing.
IMPROVEMENTS & FIXTURES: The Real Estate includes all improvements and permanent fixtures used in connection with it, now in or on the Real Estate.
SURVEY: Buyer may have a survey of the property prepared at Buyer's expense, but such survey shall not be a condition to the closing. Buyer acknowledges that Buyer is drawing solely upon Buyer's own judgment as to location, boundaries, area of the property and improvements thereon with no representations being made by Seller or its agents. The conveyance shall not be subject to any matters which are disclosed by a survey of the Property and any zoning or other statutes, ordinances, or regulations, and no representation or warranty is given as to zoning or any use of the property for any purpose.

Buyer will be responsible for paying a $195.00 transaction fee to be collected at closing.
NOTE: The successful bidder will be required to enter into a written agreement to purchase improved real estate contract irrevocable with earnest money deposited at the auction site immediately following the auction. By executing this agreement, buyer is making an offer to seller; buyer's offer expires at 11:59 P.M. (local time) __July 2, 2008__ unless seller timely accepts it.
